Ownership of Rights
Unless otherwise stated by 1688.com and its applications (collectively, the “1688 Platform”), all rights (including copyrights, trademark rights, patent rights, trade secrets and other relevant rights) in, of and to all products, technologies, software, programs, data and other information (including but not limited to texts, logos, images, pictures, audios, videos, charts, color schemes and layouts) on 1688 Platform are owned by 1688 Platform’s service providers and/or their affiliates. Monitoring, reproducing, disseminating, displaying, mirroring, uploading, downloading or otherwise using any content of 1688 Platform through robots, spiders or other programs or devices without the permission of 1688 Platform’s service providers and/or their affiliates are prohibited.
1688 Platform’s texts and/or marks of “阿里巴巴” and “alibaba”, as well as its other marks, logos, product names and service names (including but not limited to “TrustPass (诚信通)”), are the trademarks of 1688 Platform’s service providers and/or its affiliates in the People’s Republic of China (the “PRC”) and other countries. Any use of the foregoing, such as for promotional or display purposes, shall be subject to the prior written authorization of 1688 Platform’s service providers and/or their affiliates.
Other texts and/or marks, logos, product names and service names in respect of which 1688 Platform’s service providers and/or their affiliates do not claim rights may be the trademarks of their respective owners, and it shall not be understood that you have the right to use any of the foregoing trademarks displayed on 1688 Platform without the consent of its owner.
Disclaimer
The information on shops and commodities (including but not limited to shop names, company names, contact persons and contact information, product description and specifications, pictures and videos) on 1688 Platform is provided and uploaded solely by each user, who shall bear the legal liability for the information so provided and uploaded. If it is otherwise agreed by1688 Platform’s service providers on the foregoing, they will specify the same in the relevant agreement or other legal instrument entered into with you.
1688 Platform reposts works (including contents on forums) for the purpose of delivering information, which does not mean that 1688 Platform agrees with the viewpoints therein or has verified the contents thereof.
Protection of Intellectual Property Rights
We respect intellectual property rights and oppose and combat any infringement upon intellectual property rights. If the owner of any intellectual property right believes that any content on 1688 Platform (including but not limited to any commodity information posted by a user of 1688 Platform) infringes upon his/her/its legitimate rights and interests, he/she/it may make a complaint through Alibaba's IP Protection Platform (click here), and 1688 Platform will deal with such complaint after receiving a qualified notice from such owner in accordance with the applicable laws and regulations and 1688 Platform’s rules.
This Legal Notice shall be governed by the PRC laws.
Any dispute hereunder shall be under the jurisdiction of the people's court of the place where 1688 Platform Service Providers are dmiciled.
In case of any discrepancy between the English version and Chinese version hereof, the English version shall prevail.
