协议内容与效力说明：当您在中国境外浏览淘宝平台相关网页、通过淘宝平台购买商品及/或服务，或您的收货地区设定为境外地区（以下合称“本服务”），均受《境外地区消费者购物协议》（以下简称“本协议”）特别约定。仅为本协议之目的，中国境外指除中华人民共和国大陆地区之外的国家或地区，其中亦包括中国香港、中国澳门和中国台湾。
Content and Validity: When you browse and purchase goods and/or services through Taobao platform and related web pages outside the mainland of China or your shipping address is located outside the mainland of China (hereinafter collectively referred to as "this Service"), it is subject to the special provisions of the "shopping agreement for consumers in overseas regions " (hereinafter referred to as "this Agreement"). For the purpose of this Agreement only, overseas refers to countries or regions other than the mainland of the People's Republic of China, including Hong Kong, China, Macau, China and Taiwan, China.
当您在订单信息确认页面点击“提交订单”或“去支付”按钮，即表明您同意接受本协议。您在提交订单前，请仔细阅读本协议的全部内容。如果您有任何疑问，请通过客服渠道进行询问。
When you click the "Submit Order" or "Pay" button on the order information confirmation page, you shall be deemed to have agreed to accept this Agreement. You are advised to read the entire content of this Agreement carefully before you submit your order. If you have any questions, please contact customer service.
本协议是您与淘宝平台境外业务经营者或其关联公司订立的《淘宝平台服务协议》的重要补充，针对本服务的约定，本协议有约定的，优先适用本协议。
This Agreement is an important supplement to the <Taobao Platforms Service Agreement> concluded between you and Taobao or its affiliated companies. With respect to stipulations on the Service, if such stipulations are provided in this Agreement, this Agreement shall prevail.
一、购物温馨提示
I. Warming Reminders of Purchasing
因互联网具有全球性，您在中国境外时亦可使用淘宝，当您购买时请您务必全面了解商品信息，以免发生问题或导致您的损失，
Because of the Internet is worldwide, you can also use Taobao App when you are located in regions outside the mainland of The People's Republic of China, please make sure to understand the product information to avoid problems or losses when you are purchasing items on Taobao.
(1) 3C数码、电器与电子类商品，商品使用地区插头插座与商品所附插头插座与电压标准、环境可能存在地区差异，请您根据自己的需求购买，若有需要请您自行挑选购买符合您所需标准的电器或配套转换器；
For Computer, Communication, and Consumer (3C) digital, electrical, and electronic products, the plugs and sockets for such products in the Product Use Region may be inconsistent and there may be regional differences in terms of voltage standard and environment, you can purchase them based on your specific demand as well as requirements and please purchase electrical appliances or a "converter/Exchanger" that meets the local standards for supporting use of the products if you need ，
(2) 请您注意：如商品使用地区安全标准、使用人群（特别是儿童、老人和残疾人士）、使用场景与习惯、版本内容有地区性要求，请您谨慎挑选所需商品；
If the safety standards, user groups (especially children, the elderly, and the disabled), usage scenarios and habits, and version content of the products in the Product Use Region are inconsistent and different in terms of regions, please select and purchase as well as use certain products with your caution;
(3) 生产商提供的质保与售后服务可能不覆盖商品使用地区，请关注卖家提供的售后条款；
The warranty and after-sales service provided by the manufacturer may not cover the Product Use Region, and please check and pay more attention to the after-sales terms provided by the seller.
二、交付
II. Delivery
除非另有约定，若您选择自行运送或委托跨境物流服务商将商品运输至境外地区时，本服务在中国大陆地区交付，商品灭失或损毁的风险自商家在中国大陆地区将商品交付给您或您指定的第三方（包括跨境物流服务商）时即转移给您。请认真了解并遵守商品使用地区商品出入境、税收等方面的法律法规，您可能将被记录为进口方，对商品进行申报并缴纳相应税费，对合法进口商品到商品使用地区负责。
Unless otherwise agreed ,when you choose your own way or entrust a cross-border logistics service provider independently to transport the products to the overseas Regions ,the service will be delivered in the mainly of PRC, and the risks of loss or damages to the products will be transferred to you when the merchant delivers the products in the mainland of PRC to your or a third-party (including the cross-border logistics service provider) designated by you.please carefully read and comply with the laws and regulations of the product use region on the import and export of products,taxation, and other respects,you may be recorded as an importer and declare the products as well as pay the corresponding taxes ,you should take responsibility for legally importing the products to the products use Region.
三、个人信息与隐私

基于向您提供本服务或进行优化的目的，为订立、履行本协议而提供服务的物流信息系统、技术与服务器存储服务、支付服务、广告宣传等第三方服务商/合作伙伴或淘宝平台的境外地区关联公司Alibaba.com Singapore E-Commerce Private Limited须从淘宝平台经营者获取并使用您的个人信息与订单信息。
For the purpose of providing the Service to you or optimizing the Service, the third-party service providers/partners providing logistics information systems, technology and server storage services, payment services, advertising and publicity, and other services to enter into or perform this Agreement, or Alibaba.com Singapore E-Commerce Private Limited (i.e., the affiliated company of the Taobao Platforms in the Overseas Regions), shall obtain from operators of the Taobao Platforms your personal information and order information and use such information.
您同意提供您选定的第三方承运商您的物流信息，包括收件人姓名、身份证件、护照或其他通关证件号码及联系方式等必要信息，且因清关及为符合法律的规定而向境外地区海关及/或其他相关部门提供该等信息。
You agree to provide the third-party carrier selected by you, with your logistics information, including the recipient's name, identity certificate number, passport number or other customs clearance document number, contact information, and other necessary information, and to provide such information to the customs and/or other relevant authorities in the Overseas Regions for purposes of customs clearance and compliance with legal requirements.
基于本服务收集和产生的个人信息，将在中华人民共和国境内存储。同时，前述境外地区关联公司所在地、第三方服务商/合作伙伴、第三方承运商与报关单位可能会获取您相关的必要信息，并仅基于履行本协议目的使用您的个人信息。
Personal information collected and generated based on the Service will be stored within the territory of the People's Republic of China. At the same time, the aforementioned affiliated company in the Overseas Regions, third-party service providers/partners, third-party carriers, and customs clearance entities may obtain the necessary information related to you, and use your personal information only for the purpose of performing this Agreement.

[Outbound Data Transfer and Security Requirements]
您作为境外买家，为处理您的跨境退货需求，淘宝会允许您通过公共互联网远程访问存储于中国境内的部分卖家退货收件人信息，包括卖家用于接收退货的收件人姓名、联系方式、退货的收件地址，用于您向卖家寄回退货（亦称“退货跨境回寄”），淘宝仅会向您提供访问权限，上述信息原则上不会在中华人民共和国境外存储，但若您选择复制、下载或保存上述信息，可能会涉及上述信息被存储在您所在的国家/地区。
If you, as an overseas buyer, need to deal with the cross-border return of the product you purchase, Taobao will allow you to remotely access, through the public Internet, part of the information on the seller's recipient of returned goods to be stored within the territory of the mainland of China, including the recipient's name, contact information, and address that the seller provides to receive returned products, which is available to you for sending the returned product to the seller (also known as the "Cross-border Shipping of the Returned Products"), and Taobao will provide you with access permissions only. In principle, the said information will not be stored outside the territory of the People's Republic of China, but if you choose to copy, download, or save such information, it may involve the storage thereof in your country/region.

作为境外买家，您知悉且同意，您对信息的处理方式仅限于收集（通过公共互联网远程访问），存储（若您选择复制、下载或保存上述信息），使用（仅限基于跨境退货回寄的目的，向物流承运商提供）与删除。
As an overseas buyer, you acknowledge and agree that your processing of information is limited to collection (by remote access through the public Internet), storage (if you choose to copy, download, or save such information), use (only for the purpose of cross-border return of certain products, providing the aforesaid information to the logistics carrier), and deletion.
您知悉且同意，您使用淘宝向您提供的卖家上述信息的行为须符合中国内地及您所在国家/地区相关法律法规（合称所适用的法律），包括但不限于中国内地《数据出境安全评估办法》、《中华人民共和国个人信息保护法》等所规定的数据保护要求，且不得违反您与退货物流服务提供方等第三方之间的约定（若有），否则您须承担相应的法律责任，例如继续履行数据保护义务、消除影响、赔偿损失等。
You acknowledge and agree that your use of the information provided by Taobao must comply with the relevant laws and regulations of the mainland of China and the country/region where you are located (hereinafter collectively referred to as the "Applicable Laws"), including but not limited to the data protection requirements stipulated in the <Measures for the Security Assessment of Outbound Data Transfer>(Only Chinese Version), and the <Personal Information Protection Law>(Only Chinese Version), and shall not violate the agreement (if any) between you and a third party such as the returned goods logistics service provider, otherwise you shall bear the corresponding legal liability, such as continuing to fulfill data protection obligations, eliminating negative effects, and compensating for any loss.
您知悉且同意，您使用淘宝向您提供的卖家上述信息的目的和用途，仅用于满足您完成售后服务向卖家寄回退货的目的；禁止未经卖家或淘宝明确同意或超出卖家及淘宝授权范围使用上述信息或非法向他人提供上述个人信息。
You acknowledge and agree that your purpose of using the seller's above information provided by Taobao to you is limited to send the returned product to the seller upon completion of the after-sales service; and that you are prohibited from using the above information or illegally providing the above personal information to others, without the express consent of the seller or Taobao, or beyond the scope of the authorization from the seller and Taobao.
您知悉且同意，您持有和保管上述卖家个人信息的期限为实现退货跨境回寄所必要的最短时间，您最迟应在完成商品退货回寄或本协议终止后7日（自然日）内删除所持有的上述信息（包括所有备份）。若出境数据面临篡改、破坏、泄露、丢失、转移或者被非法获取、非法利用等风险时，或您面临所在国家、地区政府或公共机构调取导致数据控制权发生实质性变化，或者若您所在国家/地区数据安全保护的政策法规、网络安全环境发生重大变化，因不可抗力导致难以保障上述信息安全的，您尽量采取适当的安全补救措施(如脱敏)，以减轻对卖家和淘宝的不利影响，必要的情况下，及时将上述紧急事件告知卖家或淘宝。
You acknowledge and agree that the period for which you hold and keep the seller's personal information is the shortest time necessary to complete cross-border shipping of the returned products, and you shall delete the above information (including all backups) within seven (7) days (natural days) upon completion of product return or termination of this Agreement. If the outbound data is exposed to a risk of tampering, destruction, disclosure, loss, transfer, or illegal acquisition or use, or if you are subject to a substantial change in data control due to data access by any government agency or public institution in your country or region, or there are significant changes in the policies, regulations, and network security environment for data security protection in your country/region, and all of these force majeure events render it difficult to ensure the security of the above information, you shall try to take appropriate security remedies (such as data masking), to reduce the ill effects brought to the seller or Taobao, and where necessary, promptly inform the seller or Taobao of such emergency event.
除向您提供退货跨境回寄必要服务的物流承运商以外，您不得将上述信息提供给位于中华人民共和国境外的第三方，除非根据所适用的法律要求或取得卖家或淘宝的单独授权，并确保上述第三方有相当的数据安全保护水平。
Except for the logistics carriers that provide you with the necessary services for cross-border shipping of the returned products, you shall not provide the aforesaid information to any third parties located outside the People's Republic of China, unless required by the Applicable Laws or separately authorized by the seller or Taobao, and unless you can guarantee that the such third parties have a considerable level of data security protection.
除本条有特殊约定外，本条不影响您已接受并同意的淘宝平台其他隐私权政策，该等隐私权政策仍适用于您在前述平台的浏览与购买等行为。
Except for special agreements in this Article, this Article does not affect other privacy policies of the Taobao Platforms that you have accepted and agreed to, swhich still apply to your browsing, purchasing, and other acts on the Taobao Platforms.
四、适用法律与争议解决
IV. Governing Laws and Dispute Resolution
本协议自您提交订单之日起生效，有效期叁年，每到期后自动续约叁年，直至您与淘宝网之间的协议到期而终止。但本协议约定的关于接收数据的处理、安全保障等相关义务，并不因协议到期而终止；因本协议所产生的争议，均应依据中华人民共和国法律予以处理，若争议无法有效协商解决的，应任何一方的要求并通知另一方，争议应提交香港国际仲裁中心 (“HKIAC”) 根据提交仲裁通知时有效的HKIAC仲裁规则进行仲裁解决，仲裁小组应由一名仲裁员组成，仲裁地点为中国香港，仲裁须以中文或英文进行。HKIAC的裁决为终局裁决，对您和我们均具有约束力。
This Agreement shall take effect from the date on which you submit the order, and shall be valid for three (3) years. It will be renewed for three (3) years automatically after each expiration hereof, until the agreement between you and Taobao is terminated upon expiration. However, the obligations related to the processing and security of the received data stipulated in this Agreement shall survive the expiration hereof. Any dispute arising from this Agreement shall be handled in accordance with the laws of the People's Republic of China.
If the Dispute cannot be effectively resolved through negotiation, upon the request of either party and notification to the other party, the Dispute shall be submitted to the Hong Kong International Arbitration Centre (“HKIAC”) for arbitration in accordance with the prevail HKIAC Arbitration Rules when the Notice of Arbitration is submitted. The arbitration shall consist of one arbitrator. The location of arbitration shall be Hong Kong, China. The arbitration shall be conducted in Chinese or English. The decision of HKIAC shall be final and binding on both parties .
