Ownership of Rights
Unless otherwise stated by Taobao, all rights (including copyright, trademark rights,patent rights, trade secrets and other related rights) in and to all official products, technologies, software, programs, data and other information released by Taobao (including text, icons, images, photographs, audio, video, charts, color combinations, layout designs, etc.) are owned by Alibaba Group and/or its affiliates. Any unauthorized use of the above content or information without the prior permission of Alibaba Group and/or its affiliates may infringe their rights, and we will hold the infringer legally liable. If you wish to use any of the foregoing for promotion, display or any other purpose, you must first obtain the permission of Alibaba Group and/or its affiliates.
Information Management
To maintain the normal operation and efficiency of Taobao, no person may, without the permission of the Taobao service provider and/or its affiliates, themselves carry out, authorize others to carry out, or assist any third party in carrying out, any scanning and/or probing of Taobao and its systems (such as address scanning, network port scanning or operating system probing), or obtain or use any content within Taobao without authorization by any means, including monitoring, copying, disseminating, displaying, mirroring, uploading or downloading through bots, crawlers, automated programs or devices, or simulating user operations.
Access Rules
Taobao is committed to continually improving the service experience for users in a compliant, secure and trustworthy manner. To safeguard the transaction and data security of Taobao, and to maintain the normal operation of Taobao and the legitimate rights and interests of the relevant parties, no third-party agent
or automated program may, without the prior and explicit written permission of the Taobao service provider and/or its affiliates and completion of the necessary security and compliance assessments, access, use or operate Taobao's related products and services (including but not limited to account login and management; claiming and use of discounts or offers; searching,browsing and obtaining of product or service information; placing orders,payment and reviews/comments; after-sales service and the protection of rights; and operations related to opening and running a store). No third-party agent or automated
program may conceal,hide or misrepresent its identity or authorization status; where a security verification mechanism such as a CAPTCHA or human-machine recognition is triggered, it must respond truthfully and cooperate, and it may not evade or defeat the verification mechanisms or security measures by bypassing, cracking or any other similar means. Where any conduct disregards or violates the foregoing requirements, we are entitled, in accordance with the relevant laws and regulations and the platform's agreements and rules, to impose necessary technical restrictions and risk-control measures, and we reserve the right to hold the relevant parties liable and to claim compensation for losses in accordance with law.
Limitation of Liability
As the information publishing service provided by Taobao is in the nature of an electronic bulletin board (BBS), the third-party stores and product information on Taobao (including but not limited to store names, company names, contacts and contact details, product descriptions and instructions, related images,videos, etc.) are provided and uploaded by users themselves, and users are legally liable for the information they provide and upload. Where the Taobao service provider provides otherwise, this will be set out in the relevant agreement or other legal document.Works republished by Taobao (including forum content) are made available for the purpose of conveying further information, and this does not mean that we endorse the views expressed in them or have verified the authenticity of their content. Any entity or individual who finds that the above works contain false information or appear to infringe their legitimate rights and interests may give us feedback or file a complaint through the channels designated by Taobao; we will promptly verify the matter upon receiving the feedback or complaint and handle it in accordance with laws and regulations.
Intellectual Property Protection
We respect intellectual property rights and oppose and take actions against any infringement of them. If an intellectual property rights holder believes that Taobao content (including but not limited to product information published by Taobao users) infringes their legitimate rights and interests, they may file a complaint through the Alibaba Intellectual Property Protection Platform (https://ipp.alibabagroup.com/), and we will handle it promptly in accordance with the relevant laws and regulations and the platform rules upon receiving a qualified notice from the intellectual property rights holder.
