Our service
We provide our service on the site www.aliexpress.com(whether app, PC or other version) as an intermediary between you and the sellers. Please kindly note that we do not act on behalf of either you or the sellers, nor are we involved in any transaction between you and the sellers.
Should you have any inquiries, you can contact us through our “Help Center” where you can access our online chat service.
Please kindly note that we are not responsible for the quality, safety, legality, or availability of any item or service offered on the site, nor can we be held responsible for the seller’s ability to sell. We cannot be held liable for any loss, damage, claims, liabilities, costs or expenses arising from orders made on the site. Additionally, we cannot be held liable for any indirect damages such as loss of profits, commercial opportunities, reputation or data.

Access conditions to our site and service
Access to our site and service is subject to your acceptance of these Terms and Conditions. To engage in transactions on our site, you must first become a member by registering on our site.
If you are a minor under applicable law (usually below 18 years old), we regretfully remind you that you cannot use our site, as our service is prohibited to minors.
Please be advised that our Terms and Conditions can be updated from time to time. Should we notify you of any such changes and/or the revised terms and conditions, your continued use of our service shall be considered as acceptance of the updated Terms and Conditions.

Your transactions on our site
When making a purchase on our site, please kindly note that you are entering into a sales contract or transaction with the relevant seller.
You can access the seller's information, along with legally required information by clicking on the store name through the product page or store page, or in the product page as the case may be.
Should we become aware of an illegal product being offered by a seller, we will promptly inform you of the product's illegality, the seller's identity, and provide you with information on the appropriate redress mechanisms available, as described in Clause 7.
Please kindly note that we reserve the right to charge service fees on your transactions.
As a consumer, you have the right to cancel or withdraw from transactions, as stated in Clause 3.2. Furthermore, you are entitled to legal guarantees provided by the seller. Additionally, we offer an additional commercial guarantee (our “Buyer Protection Plan”), as described in Clause 2.3.

Optional service
Please kindly note that certain services on our site are optional and may require you to enter into a separate agreement, such as for the use of Alipay service. Details about this service can be consulted at the following link: Alipay Services Agreement.
Should you decide to discontinue using this optional service, you may do so at any time under the terms and conditions of the Alipay Services Agreement.
Furthermore, for each product several logistics solutions may be offered by the seller, for which you will need to enter into a separate contract with the relevant seller, who will then organize and provide appropriate logistics services under their own responsibility.

Prohibited uses
We strictly prohibit the use of our site for illegal activities, such as disseminating illegal content or providing false, misleading or deceptive information, or infringing upon our rights or the rights of others, including intellectual property rights.
To ensure compliance with the Terms and Conditions, we employ automated and human moderation tools. We reserve the right to take measures affecting your use of the service.
Should you fail to comply with our rules, we may take the following restriction measures:

Alternatively, you may choose to seek resolution through an out-of-court dispute settlement body (Clause 13.4.3) or pursue legal action.

Notices
Please be advised that you can report any illegal product or content on our site by clicking on “Report the item” on the product page. Your notification must state the reasons why you believe the content is unlawful, provide the link to the content, your name, e-mail address and a statement of good faith, as per Clause 11.1.1. We will acknowledge receipt of your notification and keep you informed of any decisions made and any redress available, provided we have your contact details.
Following our response to your notification, you may file a complaint within six months of our response. You can lodge your complaint free of charge using the form available in the Message Center. Once you have submitted a notice or complaint, you can choose a certified out-of-court dispute settlement, please refer to Clause 13.2.

Our site offers a recommender system that tailors product recommendations based on your member profile and behavioral data. If you wish to opt-out of this feature, you can adjust your cookie preferences upon your first visit of our site or through the “Privacy settings” in the “Message Center”.

No Specific Warranties
We do not guarantee that our service will be uninterrupted or error-free, nor can we guarantee the accuracy, truthfulness or completeness of information provided by other users.

Applicable law and disputes
This contract is governed by the laws of the special administrative region of Hong Kong, but this does not affect the protection provided by mandatory provisions in the laws of the EU/EEA/UK and the country of your habitual residence. You are entitled to exercise all relevant rights under these laws.
In the event that you are unable to amicably resolve your dispute with a seller, you may submit the matter to us. We may request additional information or documents from you or the seller.
Please kindly note that we do not serve as a judicial or arbitration institution and we will make decisions as an ordinary non-professional person. If you are unsatisfied with our decision, you may request arbitration via the Hong Kong Arbitration Center ("HKIAC") and notify us of this request within 20 days of receipt of our decision.

Any dispute with us will first be subject to amicable consultation.
If the dispute remains unresolved within 30 days from the start of this consultation, it may be submitted to administrative arbitration through the Hong Kong International Arbitration Center ("HKIAC").
Nevertheless, you retain the right to exercise your rights as a consumer of EU/EEA/UK and file a claim regarding your statutory rights in the courts of the country where you reside. Please kindly refer to Clause 13.2 for more details.
