This Taobao Platform Privacy Policy (Overseas Version) (this “Privacy Policy”) is formulated by TAOBAO (SINGAPORE) E-COMMERCE PTE. LTD. (with its registered address being 51 Bras Basah Road, #01-21 Lazada One, Singapore 189554 and registration number being 202142628W) (“we”, “us” or “our”), and applies to the access to and use of Taobao platforms by non-mainland users. The protection of your privacy and personal information is highly valued by us. Before using our services, please carefully read this Privacy Policy, especially the clauses in bold/underlined, and ensure that you have fully understood and agreed with this Privacy Policy. If you have any questions, comments or suggestions on the contents of this Privacy Policy, you may contact us via the contact details specified in “XIV. Contact Us” hereof.

For the purpose of this Privacy Policy, “non-mainland” means countries or regions other than the mainland of the People’s Republic of China, for avoidance of doubt, non-mainland also includes Hong Kong, Macau and Taiwan; and “non-mainland user” means a user who is identified as non-mainland individual in real-name authentication, is registered with a non-mainland mobile number, is located in a non-mainland country or region and registered with email address or third-party account, or is otherwise reasonably identified by Taobao platforms as non-mainland user (subject to the determination by Taobao platforms, and excluding any user who is identified as mainland individual in real-name authentication or who uses a mobile number of the mainland of the People’s Republic of China in registration and is not identified as non-mainland individual in real-name authentication).

“Taobao platforms” refers to the business-to- consumer e-commerce platforms that link and facilitate the sales and purchases between sellers and buyers. This Privacy Policy sets out how we collect, use and disclose data, including personal information, in our business operation.

I. Data Collection

To use the core functions of our products and/or services, you are required to provide necessary personal information, such as your account information, payment information, transaction information, identity information and other information that is essential for cross-border transactions. You will be unable to use our products/and or services normally if you choose not to provide such essential personal information.

To optimize your experience and provide additional functions, we may ask you to provide us with non-essential (optional) personal information on a voluntary basis. If you choose not to provide such non-essential personal information, it will not affect your use of the core functions of our products and/or services. The types of personal information we will collect from you, directly or indirectly, depend on your specific interactions with us and with Taobao platforms. Generally, the types of personal information we will collect are as follows:

(I) Data provided by you to us

When you use our services, we may ask you to provide the following personal information:

Account information	Such as name, account name, nick name, birth date, sex, phone number, email address, avatar and account password.
Payment information	Such as credit card used in the transaction or similar payment information, billing and shipping addresses, taxpayer identification number for invoice or other tax voucher (if required).
Purchase information	Such as purchase record, product details and quantity, order ID, logistics information (such as name of recipient, shipping address, contact information, and geographic location), and other information for delivery, return, refund, tax assessment and payment completion.
Service information	Such as data related to our services or transactions on Taobao platforms, including photos submitted by you and access to your camera or microphone enabled when you search for products, post a product review or lodge a complaint, and your communications with Taobao platforms through email, Aliwangwang, telephone call or otherwise.
Identity information	Such as identity card, passport and other identity information for customs clearance, after-sales services, account retrieval, and real-name/biometric authentication.
General personal information	We may collect certain general personal information that cannot be used to identify you when you voluntarily choose to disclose or provide such information, such as body type, height, bust/waist/hip measurements, and weight, for the purpose of recommending clothing size or style, providing fit prediction services or otherwise.

(II) Data collected by us by automated data collection

When you use our services, we may collect the following information by automated data collection:

Activity information	Such as information on your purchases on Taobao platforms (such as the category and specifications of purchased products, price details (including discounts and actual payment amounts), order information (including order number, creation time, and special notes), product delivery information, transaction dispute records, buyer-seller communications, and information published/disclosed during interactions.
Use information	Such as information pertaining to your use of and interactions with Taobao platforms, including your operation records (search history, likes, cart additions, reviews, questions, answers, shares, Wishlist additions, subscriptions, follows, and content additions), IP address, clipboard information, access timestamps, device type, device identifiers, volatile identifiers, application information, device parameters and system information, network environment information, network carrier information, broadcast component information, service logs, visitor information (browser, operating system, software/hardware attributes, pages viewed, and visitor counts), and information on details of your interactions with Taobao platforms and in respect of products and services offered on Taobao platforms.
Derived information	We may derive or infer certain non-identifiable information from your shopping patterns and behaviors collected by us, such as personal preferences and characteristics including your style preferences, category preferences and color preferences.

(III) Data obtained from third parties

We may obtain your personal information from third parties. For instance, we will verify your account information through payment service provider when you log in to/register for Taobao platforms with a third-party account. We will collect the following personal information from the following types of third parties only if we are satisfied that the relevant third party has obtained your consent or if the law permits or requires it to provide your personal information to us:

Compliance information	For instance, we may obtain your name, email address, contact details and other information necessary for identity authentication from our partners so as to combat fraud and ensure security.
Logistics information	Such as shipping information, address, POD, logistics service provider, and product fulfillment path data.
Account information	Such as your third-party account name, email address and profile obtained by us from a third party when you choose to log in to/register for Taobao platforms with a third-party account.

II. Use of Personal Information

We will collect and use your personal information for the following purposes:

Registration for and management of accounts of Taobao platforms: including setting up payment/transaction account, enabling binding or federated login/registration with your third-party account, displaying your personal information, entitlements and transactions in your account of Taobao platforms, and verifying your identity and registration information pursuant to relevant laws, regulations or risk control requirements;

Customer service and support: such as giving feedbacks, and handling complaints, claims and/or disputes;

Services of Taobao platforms: including but not limited to:

(1) product or service display, so that you may browse and search products and services and add them to or remove them from your shopping cart;

(2) facilitating your transactions, processing transactions and payments, helping in logistics services performance, and enabling purchase order inquiry and management;

(3) enabling information posting, such as in reviews, comments, sharing and personal homepage; and

(4) notification and other platform services;

Support to buyers and/or sellers in respect of taxation and customs clearance filing;

Membership/event benefits (if applicable): including but not limited to coupons, discounts, and membership privileges, depending on the specific membership tier or event for which you have registered;

Security safeguards: such as evaluating and monitoring transaction risks, detecting and preventing fraud and money laundering, identifying violations, maintaining information network security, preventing and responding to security incidents, and implementing necessary recording, analysis, and mitigation measures as required by law;

Recommendation and personalization: such as using your personal information to recommend features, products and services that may interest you, identify your preferences, and generate/match content, products or services through AI-powered e-shopping guidance;

Marketing campaigns: such as using your profile, account information (nickname, avatar, tier), contact details, shipping address, order history, and browsing records during promotions and campaigns, so as to facilitate your event participation and benefit redemption, display your nickname/avatar in live-stream interactions, and generate statistics;

Advertising: such as delivering customized marketing and advertising tailored to your interests based on your use patterns, browsing history, and order records. We may use cookies and similar technologies to send commercial information such as targeted promotional content (available in selected regions only) and questionnaires via email, push notifications, SMS, and other channels. If you wish to opt out of receiving advertising or commercial communications from Taobao platforms, you may unsubscribe through SMS, email or telephone, or directly contact our customer service personnel for subscription or disabling;

Research and analytics to ensure the security of Taobao platforms: improving the content and layout of Taobao platforms, and optimizing platforms, product offerings and services;

Algorithm training and decision analysis: after being securely encrypted and rigorously de-identified, the collected information may be used by us for machine learning, algorithmic model training, or other data analysis and mining purposes, so as to enhance product experience, support business decision-making analysis and optimize the models; and

12.

To the extent permitted by applicable data protection laws, we may use your personal information for other purposes compatible with those disclosed to you.

III. Disclosure and Sharing of Personal Information

(I) We may disclose or share your personal information to or with the following types of recipients:

Sellers on Taobao platforms: In order to perform the purchase orders and the services, the Sellers will obtain your personal information in connection with your transactions and communications on Taobao platforms with them, and may provide the same to third parties engaged by them, if necessary. For information on how your data will be processed by sellers, please refer to the corresponding seller’s privacy policy;

Other buyers on Taobao platforms: When you use our services, you may share your personal information with others. For instance, when another user is browsing products on Taobao platforms, he/she may see your product reviews, questions/answers, avatar and nickname (if you choose to give an anonymous review, your avatar and nickname will not be displayed to other users);

Third-party business partners, service providers and/or affiliates: They will provide services to you as entrusted by or in collaboration with us, or will process your personal information for purposes specified in this Privacy Policy or notified to you when we collect your personal information. For example:

Business partners, such as third parties that provide spend-based instant discount or benefit redemption. You agree that we may provide your necessary personal information to them to the extent permitted by applicable data protection laws;

(2)

Marketing and advertising partners that process information related to advertising placement, reach, effectiveness and microtargeting, such as Google, X, Facebook, Instagram, and Appsflyer (a user behavior analytics service provider). We may provide your user ID, certain operation information (including your Wishlist and shopping cart information) and device information to such authorized partners to the extent legal and necessary. Our partners may combine information collected from Taobao platforms with information from their own platforms, other websites or other sources to deliver targeted advertising. Information processing by third-party marketing service providers are governed by their respective privacy policies;

Third-party payment service providers, such as Alipay (China) Network Technology Co., Ltd, Alipay Singapore E-Commerce Private Limited, and other third parties that independently provide payment services on Taobao platforms (including payment through Alipay, WeChat pay or other payment methods specified on the relevant webpage). These payment service providers may, either by themselves or through Taobao platforms, collect necessary information for making payment, such as your account, transaction and payment verification information. If such information is collected through Taobao platforms, we will provide the relevant information to such payment service provider selected by you, to confirm your payment instruction and help completing your payment. Please note that certain activities of payment service providers may be governed by their privacy policies instead of this Privacy Policy;

Logistics service providers, such as Zhejiang Yunjishang Network Co., Ltd(浙江云吉尚网络有限公司)., Zhejiang Speed Chain International Supply Chain Management Co., Ltd.（浙江速链国际供应链管理有限公司）, and Hangzhou Cainiao Supply Chain Management Co., Ltd（杭州菜鸟供应链管理有限公司）., which provide buyers with cross-border logistics services for deliveries and returns. Taobao platforms may provide them with your personal information to the extent necessary, such as your order information, recipient name, recipient address and contact details. To help you automatically populate your address, and to recommend nearby products, services or logistics service centers to you, Taobao platforms may also provide your geographic location to the logistics service providers. For details, please refer to the privacy policy of the relevant logistics service provider;

Customs agents for customs clearances that support buyers and sellers in cross-border sales/purchases where necessary;

Cloud computing or other hosting service providers;

(7)

Channel (applet) service providers. To facilitate your use of channel (applet) services provided by our partners, our partners, such as channel (applet) developers, will use your nickname, avatar and other personal information;

Customer service providers that provide after-sales services or on-line local customer service support, such as Daythree Business Services Sdn. Bhd;

(9)

Risk control service providers that assess the security of buyer accounts and seller account and the transaction risks;

(10)

Professional advisers, law enforcement agencies, insurers, government authorities, regulatory authorities and other organizations, if we believe it is necessary to comply with applicable laws, or to exercise or establish our legal rights, or to protect your vital interests or those of any other person, or is otherwise required or permitted by applicable laws;

(11)

Translation service providers that provide translation services for buyers and sellers of different languages, such as Hangzhou AliExpress Information Consulting Co., Ltd. (杭州速卖通信息咨询有限公司). For details, please refer to the <Users Notice of Content Translation>;

Third parties in the case of binding login. Subject to your consent, we may share your account information (such as avatar and nickname) with a third party, so that you may conveniently register an account with, or log in instantly to the website or application of, the third party;

(13)

Software Development Kit (SDK). Application of Taobao platforms may integrate independent SDKs or similar applications of our authorized partners. For details, please refer to the <Third-Party SDK Information Collection and Use Statement of Taobao Platforms>; and

(14)

Other cooperation scenarios. In addition to the cooperation scenarios above, Taobao platforms may entrust information processing to our other business partners, including those entrusted by us to provide technology infrastructure services, to analyze use patterns of our services, or to provide merchant membership services or other customer services.

When we entrust a partner to process your personal information so that the partner may provide certain services or perform certain duties for you on our behalf, such entrusted processing will strictly comply with the lawful, legitimate, necessary, specific, and explicit purposes specified herein. Our partners will have access only to the information necessary for the performance of their duties, and will be contractually required not to use such information for any purpose other than as entrusted. If any partner intends to use your information for any purpose other than as entrusted by us, it will seek your separate consent.

Data collection, storage and other processing under this Privacy Policy are the sole responsibility of TAOBAO (SINGAPORE) E-COMMERCE PTE. LTD, being the owner of this Privacy Policy. Subject to regulatory requirements and this Privacy Policy, TAOBAO (SINGAPORE) E-COMMERCE PTE. LTD. may, in light of actual needs, entrust Zhejiang Taobao Network Co., Ltd. (established under the PRC laws) with data processing, and transmit data to it within the scope of such entrustment, and Zhejiang Taobao Network Co., Ltd. will provide necessary technical support only as instructed by us. With respect to the sharing of personal information with a business partner, we will enter into an agreement with it in accordance with law, specifying the respective rights and obligations, so as to ensure its compliance with laws and data security during its use of the relevant personal information.

(II) Transfer: If we need to transfer personal information due to merger, division, dissolution or declared bankruptcy, we will inform you of the name and contact information of the transferee, who will continue to perform this Privacy Policy and other statutory obligations. If the transferee intends to change the original processing purposes or methods for your personal information, it will obtain your renewed consent.

(III) Disclosure: We may disclose your personal information only if:

such disclosure is made pursuant to law or at your option or otherwise with your consent; or

you have violated laws or regulations, or have breached any of the agreements with or rules of Taobao platforms, or we have to protect users of Taobao platforms or the general public from damage to their personal or property safety.

(IV) Independent third-party services:

Taobao platforms may contain links to websites operated by third parties, including affiliates, sellers, or payment gateways, such as Tmall, Goofish, Fliggy and Alibaba Health.

We assume no responsibility for the privacy protection measures adopted by such websites operated by third parties. You must review the applicable privacy policies of such websites to ascertain how they handle any data collected from you. Please note that even if a third party is our affiliate, we exercise no control over its website, as each website may implement its own privacy and data collection practices independent from ours.

Consequently, we disclaim all liability regarding the content, security measures (or lack thereof) and activities of and on these websites. These links are provided solely for your convenience, and all risks associated with your access to the websites shall be solely borne by you. Notwithstanding the foregoing, we remain committed to safeguarding the integrity of Taobao platforms and each link thereon. Your feedback concerning these external sites is welcome, including but not limited to your report of any link that is not functioning normally.

IV. Data Storage

We store data on servers within the mainland of People’s Republic of China; however, your personal information may be stored on servers outside the mainland of People’s Republic of China in certain circumstances, such as: 1) in scenarios involving specific data collections, in which case special explanations will be provided to you or your authorization will be obtained; or 2) in situations where storage or backup outside the mainland of People’s Republic of China is required by applicable laws and regulations.

We will store your personal information only for the period necessary for fulfilling the purposes set forth in this Privacy Policy, unless any other mandatory storage period is required under applicable laws and regulations. After the storage period expires, we will delete or anonymize your personal information as required by applicable laws. If it is impossible to do so (e.g., due to backup storage), we will securely store your personal information, until deletion is feasible.

The retention period of your data also depends on how you use our services (for example, whether you visit Taobao platforms as a visitor) and the purposes of the data provided by you. For instance, after your account is canceled or deleted, certain data will be retained to comply with legal requirements or to handle potential disputes. In other instances, the period of retention may be determined based on your activity on Taobao platforms or a specific dispute resolution period.

V. Cross-Border Transmission of Personal Information

We will only conduct cross-border transmission of (including remote access to) your personal information when legally permitted. Where such transmission is not covered by an adequacy decision or regulations, we will implement appropriate measures to ensure that the recipient undertakes confidentiality obligations, and that your personal information is protected in accordance with this Privacy Policy and applicable laws. For instance, we may conduct necessary de-identification, adopt encrypted transmission, conduct periodic security capability assessments of data recipients, and sign data processing agreements/clauses.

VI. Legal Basis for Data Processing

We process personal information for the purposes set out in this Privacy Policy. The legal basis for our processing of your personal information will depend on the specific personal information involved and the context in which we collect it. Typically, Taobao platforms will seek your consent before collecting, using, or disclosing your personal information, and you may choose to give or withhold your consent without any negative consequences. Nevertheless, your personal information may be used by our business partners or transferred or disclosed by us without your consent pursuant to applicable laws, regulations and standards if:

it is necessary for the conclusion or performance of contracts as requested by you. Specifically, when you purchase products or services through Taobao platforms, we will, at your option, share necessary transaction-related information in your purchase order with the provider of such products or services or with the relevant service provider for Taobao platforms, so as to satisfy your needs for transaction, delivery and after-sales services;

it is necessary for the performance of statutory obligations. Specifically, we may share your personal information as required by laws or regulations, for litigation or dispute resolution, by any competent authority in accordance with laws, or for the performance of other statutory obligations;

it is necessary for the protection of person or property safety of individuals under emergent circumstances; or

it is otherwise required under applicable laws.

VII. Rights Regarding Personal Information

Pursuant to applicable laws, you may have certain rights in your data, including but not limited to the right to inquire about our collection of your personal information, and to access, correct or delete your personal information.

We will grant your request to the extent permitted by applicable laws, including but not limited to:

(I) Access, correction and supplement

You may access, correct and supplement your information by:

logging in to Taobao platforms and clicking “Account - Settings”;

logging in to Taobao application and clicking “Account - Settings”; or

logging in to Taobao platforms and clicking “Help Center”, or logging in to Taobao application and clicking “Account - Help Center”.

(II) Reproduction

You may reproduce your information by:

logging in to Taobao application and clicking “Account - Settings - Privacy - Personal info download”.

(III) Deletion

You may delete some of your information by the ways set forth in “(I) Access, correction and supplement” or delete all your information by applying for deletion of your account.

(IV) Change of scope of authorization

You may change the scope of or withdraw your authorization granted to us for collecting and processing your personal information by:

changing authorizations through “Account - Settings - Privacy - Ways to find me”;

changing authorizations through “Account - Settings - Privacy - My homepage”;

changing the system permissions granted to our application through “Account - Settings - Privacy - System permission management”; or

changing the applications authorized by you through “Account - Settings - Privacy - Access management”.

For any authorization that cannot be changed through any method above, you may contact our customer service personnel.

(V) Deletion of account

You may apply for deletion of your account by:

submitting an application for account deletion through “Account - Settings - Account and security - Delete account”; or

contacting our customer service personnel to apply for account deletion.

Once you voluntarily delete your account, we will cease to provide products or services to you and will delete or anonymize your personal information as required by applicable laws. For more information, please refer to the Important Notice for Taobao Account Cancellation.

(VI) Restrictions on automated decision-making by information systems

In certain business functions, we may make decisions by relying solely on automated decision-making mechanisms, such as algorithms. If your legitimate rights and interests are affected by such decisions, you may contact us for further actions.

(VII) Management of personalized advertising and recommendation

The algorithms for personalized recommendation and search will, based on models, predict your preferences, select the products, services or other information that you may be interested in, and rank them accordingly. You may manage the personalized advertising and recommendation by:

setting up through “Account - Settings - Privacy - Advertising management” (if this option is not available to you, it means that no personalized advertising is provided or displayed to you by Taobao platforms); or

setting up through “Account - Settings - Privacy - Recommendation management”.

(VIII) Others

In addition, you may contact our data protection officer via the contact details specified in “XIV. Contact Us” of this Privacy Policy to exercise your rights in your data. If you may have any other right as data subject in addition to those specified above pursuant to other laws and regulations, you may contact us promptly, and we will grant your request to the extent permitted by applicable laws. For example:

You may object to our processing of your personal information if your legitimate rights and interests are infringed upon or if we fail to comply with laws and regulations;

You may request that we restrict the processing of your personal information or transfer the same to a third party under certain circumstances;

You may withdraw your consent and request deletion of your personal information; and

You may report to regulatory authorities in respect of collection and use of your personal information by Taobao platforms.

VIII. Cookies

This section explains how we use cookies and similar technologies (“cookies”) to recognize you when you visit Taobao platforms, and explains what cookies are, why we use cookies, and your rights to control cookies.

(I) What is a cookie?

A cookie is a string of information that is sent to your browser and stored on your computer’s or mobile device’s hard drive. When cookies are not disabled or deleted by you, each time you use the same browser or device to access Taobao platforms, our web servers will be notified of your visit to Taobao platforms and, in turn, we may have knowledge of your visit and the pattern of your usage.

Cookies created by the owner of the relevant website or application (namely, Taobao platforms in this case) are “first-party cookies”, and cookies created by third parties other than the website or application owner are “third-party cookies”. Third-party cookies are used to enable third-party features or functionality (such as advertising, interactive content, and analytics) on or through a website. The parties that use these third-party cookies can recognize your device both when it accesses the relevant website and when it accesses certain other websites.

There are two types of cookies: session cookies (which will be erased once you close the browser or shut down your device) and persistent cookies (which will remain there even after the browser is closed or your device/application is shut down and will be activated each time you visit Taobao platforms). The session cookies use encrypted data to authenticate you. Persistent cookies will not store your account name or password. We use both session cookies and persistent cookies.

(II) Why do we use cookies?

We use first-party and third-party cookies for several reasons. Some cookies are necessary for technical and/or security reasons in order for Taobao platforms to operate, and these cookies are referred to as “necessary” or “essential” cookies. Necessary cookies are mainly used to enable core functions on Taobao platforms, including web analytics cookies, which help us understand how users use our web pages and how we can enhance their experience. For example, we use necessary or essential cookies to remember products added to your shopping cart and to recognize you when you sign into your account. We also use cookies to track and target the interests of visitors to Taobao platforms to enhance their experience by analyzing visiting patterns and placing interest-based advertising, to assist our business partners in tracking users’ visits to Taobao platforms, and to track progress and participation in promotions and the results of our email marketing campaigns. IX. Minors

We do not intend to provide services to minors. If you are a minor under applicable laws, before using our services or providing us with any information, you must ask your parents or guardian to carefully read this Privacy Policy and the <Children’s Personal Information Protection Rules and Guardians Instructions>, and obtain their consent.

In the event that a minor provides his/her personal information to us without the consent of his/her parent or guardian, his/her parent or guardian shall contact us to delete such information via the contact details specified in “XIV. Contact Us” hereof.

X. Security Measures

We implement appropriate organizational and technical measures to protect your personal information. For example, we restrict access to your personal information to our employees, agents and contractors and other third parties for whom such access is necessary to fulfill their responsibilities and contractual obligations. We implement physical access restrictions at data centers and enforce logical access controls for data and system access.

In addition, we adopt appropriate technical safeguards to prevent unauthorized access, use, disclosure, modification or disposal or similar risks to the data held by us, and to maintain data accuracy. In the event of a data breach, we will notify you and regulatory authorities within such period and to such extent as required by applicable data protection laws and take necessary countermeasures.

XI. Updates of Privacy Policy

We may update this Privacy Policy from time to time in response to legal, technical or business developments. In such case, we will take appropriate measures to notify you, such as publishing the updated Privacy Policy on Taobao platforms. You are advised to check from time to time to keep up with any update or amendment.

If we cease the operation of our products and/or services, we will promptly cease to collect your personal information. In such case, we will notify you of our cessation of operation by a separate notice to you or by an announcement, and delete or anonymize your personal information in our possession in connection with the products and/or services so ceased in accordance with “IV. Data Storage” of this Privacy Policy.

XII. Others

If you believe that our processing of personal information has infringed upon your legitimate rights and interests, the dispute shall be submitted to the Hong Kong International Arbitration Centre (“HKIAC”) for arbitration in Hong Kong, China in accordance with the HKIAC Arbitration Rules in effect at the time the arbitration notice is submitted. The arbitration tribunal shall consist of a sole arbitrator. The arbitration shall be conducted in Chinese or English. The award rendered by the HKIAC shall be final and binding upon both you and us.

If any data provided by you contain any personal information of another user, please ensure that you have been legally authorized by such user before providing such personal information to us.

XIII. Languages

If there is any conflict between the Chinese version and another language version of this Privacy Policy, the Chinese version shall prevail.
